Oklahoma Passes Uniform Real Property Electronic Recording Act

Gov. Brad Henry signed House Bill No. 2587 into law on June 2, making Oklahoma the 20th state to accept the Uniform Real Property Electronic Recording Act (URPERA). The act becomes effective Nov. 1, 2008.
URPERA states that any requirement of state law describing or requiring that a document be an original, on paper, or in writing are satisfied by a document in electronic form. Furthermore, any requirement that the document must contain a signature or acknowledgment is satisfied by an electronic signature or acknowledgment. The act specifically authorizes a recorder, at the recorder's option, to accept electronic documents for recording and to index and store those documents electronically.
URPERA was drafted by the National Conference of Commissioners on Uniform State Law (NCCUSL) and approved by the American Bar Association (ABA) in 2004. No state is required to adopt a uniform or model law; however, NCCUSL's uniform and model laws provide states with the basis for legislation that promotes uniformity among the states.
Way Cleared for Electronic Submissions to Office of Administrative Heartis

Governor Brad Henry signed Senate Bill 42 into law on April 25, allowing the Office of Administrative Hearings (OAH) to accept electronic transmittals of documents and electronic signatures. Documents that, by law, require a signature or record to be notarized, acknowledged, verified or made under oath when filed with the OAH must have the electronic signature of the person authorized to perform those acts-along with all other information required by the applicable law-attached to or logically associated with the signature or record. The Oklahoma Department of Human Services will set rules for implementing electronic filing and signatures for the OAH. The new law becomes effective November 1.
